Terms of Service

smokan (the “Service”) is published by ByTaishiro, operated by Anthonin Jomier (sole proprietorship, France), and available at smokan.app. The Service lets a user connect their Twitch account to automatically analyze their VODs and pull out short-form (9:16) highlights (“clips”), ready to download or publish on third-party platforms (YouTube, TikTok, Instagram).

By creating an account or using the Service, the user acknowledges that they have read, understood and unreservedly accepted these Terms of Service (the “Terms”). If the user does not accept these Terms, they must not use the Service.

Access to the Service requires creating an account, either with email/password or through a third-party identity provider (Google, Discord). The user is responsible for keeping their credentials confidential and for all activity carried out from their account. The user must be at least 16 years old to use the Service.

The user warrants that they hold the rights required for the VODs they submit to the Service (typically their own Twitch streams) and is solely responsible for the content they process, download or publish through the Service. smokan exercises no prior editorial control over this content and cannot be held liable for any use that breaches the terms of service of Twitch, YouTube, TikTok, Instagram or any other third party.

The clips generated by the Service remain the property of the user. smokan claims no intellectual property rights over the source or generated content, other than a technical usage right strictly necessary to operate the Service (temporary storage, processing, preview).

Some features are offered through a paid subscription, billed periodically via our payment provider Stripe. Displayed prices include all applicable taxes. The user can cancel their subscription at any time from their dashboard; cancellation takes effect at the end of the current billing period. Unless otherwise required by law, amounts already paid are non-refundable.

It is prohibited to use the Service to:

• process content the user does not hold the rights to;
• circumvent the technical or pricing limits of the Service;
• disrupt the proper operation of the Service or its infrastructure;
• break any applicable law or regulation.

The Service is provided “as is”. smokan uses reasonable means to ensure the availability and quality of the Service, without guaranteeing the absence of interruption, error, or any specific result in detecting highlights. smokan cannot be held liable for any indirect damage arising from use of the Service.

The user can delete their account at any time. smokan reserves the right to suspend or terminate an account in the event of a breach of these Terms, with prior notice where reasonably possible.

smokan may change these Terms at any time. Users will be informed of any material change. Continuing to use the Service after a change constitutes acceptance of the new Terms.

These Terms are governed by French law. Any dispute regarding their interpretation or performance falls under the jurisdiction of the competent courts.
